Prosecutors say a 19-year-old West St. Paul man told police he was concerned that someone was going to shoot at his house when his AK-47 accidentally fired and killed a teen.
Ramsey County prosecutors on Friday charged Alfredo Gutierrez-Gonzales with second-degree murder, possession of a firearm by a felon and second-degree manslaughter.
According to the complaint, he told police he was trying to put a clip into the assault rifle when it fired, hitting 15-year-old Jacob MacKenzie in the head and killing him.
It all happened about 12:30 a.m. Sunday on the front porch of a house, where Gutierrez-Gonzales slept.
After the rifle fired, a witness yelled for someone to call 911 and Gutierrez-Gonzales ran away.
Gutierrez-Gonzales’ girlfriend, Jayna Emerson, made an emotional public plea for Gutierrez-Gonzales to turn himself in to police. He did Thursday.
He was being held Friday afternoon in the Ramsey County Jail. Bail was set at $250,000. A lawyer will be appointed to represent him, but hadn’t happened as of Friday afternoon.
